Points Based System Points Based System

The Points Based System [PBS] has been introduced to assess whether a person can qualify to come to the United Kingdom for the purposes of work or study.

This represents a fundamental change in the way that applications are assessed and decided by the UK Border Agency. The immigration categories have been replaced with five separate Tiers as follows:-

  • Tier 1 Highly Skilled
  • Tier 2 Skilled Workers with a Job Offer
  • Tier 3 Low Skilled Workers
  • Tier 4 Students
  • Tier 5 Youth Mobility and Temporary Workers 

It is essential to make sure that the correct Tier is applied for.

Each Tier has a separate set of assessment criteria that has to be met by the applicant at the time of application, to demonstrate that s/he has sufficient points to qualify under the relevant scheme.

 

In addition to being able to show that the person has enough points to qualify, the applicant will also be required to show evidence that there is a sponsor in the UK who is supporting the application [except for Tier 1 applications].

 

The sponsor must be a business or college in the UK and be licensed by the UK Border Agency before an application can be made under the Points Based System. If the applicant does not have a licensed sponsor, then an application cannot be made.

Tier 1 (General) Recommended Changes

The Migration Advisory Committee(MAC) has completed its review of Tier 1 of the points-based system.

 

Earlier this year, the MAC was asked to consider whether the criteria for Tier 1 should be changed in 2010/11 to reflect changing economic circumstances. The MAC's report, published, says that Tier 1 is generally operating well, but also recommends some changes.
