Tier 2 – Skilled Workers Tier 2 – Skilled Workers

This category of the points based system was set up to allow skilled workers with an offer of employment to come to the United Kingdom to work, train or study. From 27th November 2008 the work permit scheme will be closed [except for Bulgarian and Romanian nationals].

There are different types of Tier 2 which can be applied for:·         

The sponsor must be based in the UK and hold a valid sponsorship licence to employ a person under the Tier 2 arrangements. If the sponsor does not hold a licence, then you cannot apply for permission to employ an overseas migrant or extend an existing employees permission to work in the UK.

We have managed this process on behalf of the top 500 UK employers. We can represent you on obtaining your sponsorship licence, ensuring that you are awarded an A-rating under the system.

A licenced sponsor must apply for a Certificate of Sponsorship [COS] which will need to be approved by the UK Border Agency via the Sponsor Management System. It is the responsibility of the sponsor to ensure that the individual meets the criteria for CoS when an application has been made.

The job on offer must be:

  • At S/NVQ3 skill level or above; and
  • A genuine vacancy and meet the resident labour market test, is on the shortage occupation list or is an intra-company transfer; and 
  • Paying the appropriate salary rate for the job.

 In addition to the above, the individual must meet all of the points based criteria, depending on which category of Tier 2 is being applied for.

User passwords issued for Points Based System

18 November 2008

The UK Border Agency has started to send out the passwords and user names for the sponsorship management system (SMS).

This will enable those licenced sponsors to apply for permission to employ overseas migrants in Tier 2 and Tier 5 of the Points Based System.
